本协议系由您（以下或称：「用户」）与POIZON（GLOBAL）Limited及其关联企业（以下称「POIZON平台」或「平台」或「我们」）之间就POIZON软件及服务（以下或称：「POIZON平台」）的提供、使用而在线签订。

This User Services Agreement is made online by and between you (or the “User”) and POIZON (GLOBAL) Limited as well as its affiliates (hereinafter referred to as the “POIZON Platform”, “Platform” and/or “We”) on the provision and use of POIZON software and services (or the “POIZON Platform”).

본 협의는 귀하(이하 ‘사용자’라 함)와 POIZON（GLOBAL）Limited 및 그 관계 기업(이하 ‘POIZON 플랫폼’ 또는 ‘플랫폼’ 또는 ‘저희’라 함) 간에 POIZON 소프트웨어 및 서비스(이하 ‘POIZON 플랫폼’이라 함)의 제공과 사용에 관하여 온라인으로 체결됩니다.

尽管各地法律和习惯对未成年人的定义不同，但我们将不满18周岁的任何人士均视为未成年人。 如果你未满18周岁，您需要在您法定监护人的陪同下注册、使用本软件以及阅读本协议。

Although local laws and customs may have different definitions of minors, we regard anyone under the age of 18 as a minor. If you are under the age of 18, you should register and use the Software and read the Agreement in the company of your statutory guardian.

지역마다 법과 관습에 따라 미성년자에 대한 정의가 다르지만 저희는 18세 미만의 모든 사람을 미성년자로 간주합니다. 만18세 미만의 경우 법적 보호자와 함께 본 소프트웨어를 가입하고 사용하며 본 협의를 읽어야 합니다.

我们在此特别提醒：本协议将对您使用本软件的行为产生法律约束力。您承诺和保证有权利和能力订立本协议。在您注册成为用户之前，请认真阅读本《用户服务协议》（以下简称：「本协议」），特别是免除或者限制责任的条款、隐私政策、买家须知、卖家须知、法律适用和争议解决条款（包括管辖条款）以及其他以粗体划线重点标识的条款，请您务必审慎阅读。

We hereby remind you that the Agreement is legally binding on your use of the Software. You undertake and warrant that you have the rights and capabilities necessary for the execution of the Agreement. Before you register as a user, you shall carefully read this User Services Agreement (hereinafter referred to as the “Agreement”), especially exemption or liability limitation clauses, privacy policies, notices for buyers, notices for sellers, clauses regarding governing laws and dispute settlement (including those regarding jurisdiction), as well as bold and underlined clauses.

본 협의는 귀하가 본 소프트웨어를 사용하는 행위에 대해 법적 구속력을 갖고 있음을 특별히 알려드립니다. 귀하는 본 협의를 체결할 권리와 능력이 있음을 약속하고 보장합니다. 사용자가 되기 전에 <사용자 서비스 협의>(‘본 협의’라 함), 특히 책임의 면제와 제한, 프라이버시 정책, 구매자 주의 사항, 판매자 주의 사항, 법률 적용과 분쟁 해결 약관(관할 약관 포함) 및 기타굵은 선으로 표시된 약관을 주의 깊게 읽어 주시기 바랍니다.

1. 当您按照注册或登录页面提示填写信息、阅读并同意本协议且完成全部注册或登录程序后，即表示您已充分阅读、理解并接受本协议的全部内容，并与POIZON平台就本协议达成一致，成为POIZON平台的用户。阅读本协议的过程中，如果您不同意本协议或其中任何条款约定，您应立即停止注册或登录。

Once you fill in information, read and agree with the Agreement, and complete all the registration or login procedures as prompted on the registration or login page, it is deemed that you have fully read, understood and accepted all the contents contained herein, reached consensus with POIZON Platform on the Agreement, and become the user of POIZON Platform. If you disagree with the Agreement or any clause contained herein when reading the Agreement, you shall stop registering or logging in immediately.

1. 가입 또는 로그인 페이지의 안내에 따라 정보를 작성하고, 본 협의를 열독 및 수락하며 모든 가입 또는 로그인 절차를 완료하는 것은 본 협의에 대한 귀하의 수용을 나타내며 본 협의와 관련하여 POIZON 플랫폼과합의를 달성하여 POIZON 플랫폼의 사용자가 되었음을 의미합니다. 본 협의를 읽는 과정에서 전체 또는 어느한 약관에 동의하지 않을 경우 즉시 가입 또는 로그인을 중지하십시오.

2. 您在此承诺和保证，在您完成注册程序并实际使用服务时，您应当具备管辖法律所在地区规定的与您行为相适应的民事行为能力，如您不具有前述民事行为能力的，则您应确保您在POIZON平台上的任何行为均应事先获得监护人的同意，并由您与您的监护人共同承担不利后果。

You hereby undertake and warrant that you shall have the capacity for civil conduct suitable for your behaviors as stipulated by the jurisdiction applying the governing laws when you complete registration and use the services. Where you don’t have the aforesaid capacity for civil conduct, you shall ensure that all your behaviors on POIZON Platform are approved by your guardian in advance and that you and your guardian shall bear all the negative consequences arising therefrom.

2. 가입 절차를 완료하고 서비스를 사용할 때 귀하는 관할 법률이 위치한 지역에서 규정한 귀하의 행위에 상응하는 민사 행위 능력을 갖추어야 합니다. 이런 민사 행위 능력이 없을 경우, 귀하가 POIZON 플랫폼에서 진행하는 모든 행위는 보호자의사전 동의를 거쳐야 하며 불리한 결과는 귀하 및 귀하의 보호자가 감당해야 합니다.

3. 服务形式：POIZON平台目前只包括POIZON的移动应用程序APP端。未来我们可能会提供包括但不限于PC端以及其他形式。具体以我们实时发布的服务功能界面形式为准。

Form of Service: POIZON Platform only has POIZON mobile client now. We may offer other forms of service in the future, including but not limited to POIZON PC client. The specific form of service shall be subject to the service function interface we issue from time to time.

3. 서비스 형식: POIZON 플랫폼은 현재 POIZON의 모바일 앱만 포함합니다. 향후 저희는 PC를 포함한 기타 형식도 선보일것입니다. 구체적인 사항은 저희가 실시간으로 배포하는 서비스 기능 화면에서 확인하십시오.

4. 协议范围：考虑到互联网服务的不确定性以及产品频繁迭代更新，为了更全面的界定您与我们之间的权利义务，本协议包括我们根据法律法规规定以及根据本协议制定的其他政策、规则须知、公告声明等，如内容发生不一致或有矛盾，以专门适用于某个业务场景的协议条款为准。

Scope of the Agreement: In view of uncertainties of Internet services and frequent iteration of products, the Agreement also includes other policies, rules, notices, announcements, statements and other information we prepare in accordance with the laws, regulations and rules. In the case of any inconsistency or contradiction, clauses specially applicable to certain business scenario shall prevail.

4. 협의 범위: 인터넷 서비스의 불확정성과 제품의 빈번한 세대교체를 감안하고, 귀하와 저희 간의 권리와 의무를 더욱 전면적으로 정의하기 위해 본 협의는 저희가 법률 및 법규에 의해 규정하고 본 협의에 의해 제정한 기타 정책, 규칙과 지침, 공고성명을 포함합니다. 내용이 일치하지 않거나 모순이 있을 경우 특정 비즈니스 상황에 적용되는 협의 약관을 기준으로 합니다.

5. 修改与更新：根据国家法律法规变化或POIZON平台运营需要，本协议可由POIZON平台不时地更新或修改，修改后的协议条款即代替原来的协议条款，我们会通知你协议发生变更，您可随时查阅最新版协议条款。在POIZON平台修改协议条款后，如果您不接受修改后的条款，请您立即停止使用我们提供的服务，如您继续使用POIZON平台提供的服务将视为您接受修改后的协议。

Modification and Update: POIZON Platform may update or modify the Agreement from time to time considering the change of China’s national laws and regulations as well as the operation needs of POIZON Platform. The modified clauses replace the original clauses immediately and we will inform you of any change in the Agreement. You may view the latest clauses at any time. After POIZON Platform modifies clauses of the Agreement, you shall immediately stop using our services if you disagree with the modified clauses. If you keep using our services, it is deemed that you have accepted the modified agreement.

5. 수정과 갱신: 국가 법률 및 법규의 변경 또는 POIZON 플랫폼 운영의 필요에 따라 본 협의는 POIZON 플랫폼에서 수시로갱신하고 수정할 수 있으며 수정된 약관이 기존 약관을 대체합니다. 저희는 변경 사항을 귀하에게 알려드리며 귀하는 언제든지 약관의 최신 내용을 확인할 수 있습니다. 변경된 약관에 동의하지 아니하는 경우, 즉시 서비스 이용을 중지해 주십시오. 계속 사용하는 경우는 변경된 약관에 동의하는 것으로 간주됩니다.

6. 目的使用：本软件授予用户一项个人的、不可转让、出借和赠与，非商业化目的使用的，以及免费使用（本协议另有声明的服务费用收取及本软件中单独的付费资源除外）的许可。

Purpose of Use: The Software grants the User a personal, non-commercial and free license (except for service fees otherwise stated and collected herein, as well as separately paid resources in the Software) which cannot be transferred, assigned and/or granted.

6. 목적 사용: 본 소프트웨어는 사용자에게 개인적이고 양도나 대여 및 증여 불가능한, 비상업적, 무료 (본 협의에서 별도로명시된 서비스 요금 징수 및 본 소프트웨어 중의 별도 유료 자원 제외) 사용이 가능한 라이선스를 부여합니다.

一、关于POIZON平台的服务说明

I. Description of Services on POIZON Platform

I. POIZON 플랫폼 서비스에 대한 설명

1、POIZON平台为POIZON GLOBAL Limited开发、运营、管理的一款旨在为用户（包括个人卖家、个人买家以及仅使用平台提供的商品查验鉴别服务的用户）提供个人全新闲置物品出售或购买的网络经营平台，POIZON平台仅就用户在POIZON平台展示物品/服务信息、寻找交易对象并完成商品交易提供技术服务，同时联合第三方查验鉴别服务商为用户提供商品查验及鉴别服务。POIZON平台起到促进个人卖家和个人买家进行购买交易的作用，而实际的商品交易合同只直接发生在个人卖家与个人买家之间。因此POIZON平台并非商品销售主体，也非购买主体。

1. Developed, operated and managed by POIZON GLOBAL Limited, POIZON Platform is a network platform aiming to help users (including individual sellers, individual buyers, and users enjoying the commodity inspection services of the Platform) sell or buy new idle items. POIZON Platform only provides technical services for users to display information about their commodities/ services, seek transaction counterparts, and complete commodity transaction, and offers users commodity inspection services in cooperation with third party inspection service providers. POIZON Platform helps the individual seller and individual user conclude the transaction, while the actual commodity transaction contract is directly signed between the individual seller and individual user. Therefore, POIZON Platform is not the main body of commodity sales and purchase.

1.POIZON GLOBAL Limited에서 개발, 운영, 관리하는 POIZON 플랫폼은 사용자(개인 판매자, 개인 구매자 및플랫폼의 상품 검사 서비스만 사용하는 사용자 포함)가 개인 유휴 물품을 판매하거나 구매할 수 있도록 돕는 것을 목표로 하는 온라인 플랫폼입니다. POIZON 플랫폼은 사용자가 POIZON 플랫폼에서 상품/서비스에 대한 정보를 게시하고 거래 상대를 찾아 상품 거래를 완료하는 데 필요한 기술 서비스만 제공하고 서드 파티 검사 서비스 업체와 협력하여 사용자에게 상품 검사 서비스를 제공합니다. POIZON 플랫폼은 개인 판매자와 구매자의 거래를 추진하는 작용을 하지만 실제 상품 거래는 판매자와 거래자 사이에서 발생합니다. 따라서 POIZON 플랫폼은 상품 판매 주체가 아니며 구매 주체도 아닙니다.

2. POIZON 플랫폼은 다음과 같은 서비스를 제공합니다.

（1）促进商品交易服务。我们为您销售或购买的商品提供网络经营场所，即POIZON平台利用自身技术能力搭建电商平台供个人卖家发布商品以及供个人买家购买商品，其中，平台将按照商品出价页面载明的比例向个人卖家收取平台服务费。

(1) Promoting commodity transaction. We provide you with a network-based operation space. In other words, POIZON Platform builds an e-commerce platform resorting to its technical capabilities for individual sellers to display their commodities and for individual buyers to buy what they want. In the process, the Platform will collect service fees from individual sellers at the rate specified on the commodity bidding page.

（1）상품 거래를 추진합니다. 당사는 귀하가 상품을 판매하거나 구매할 수 있는 온라인 장소를 제공합니다. 즉 POIZON 플랫폼은 자체 기술 능력에 의존하여 판매자가 상품을 게시하고 구매자가 상품을 구매할 수 있는 이커머스 플랫폼을 구축합니다. 이 과정에서 플랫폼은 상품 가격 제시 페이지에 명시된 비율에 따라 개인 판매자로부터 플랫폼 서비스 요금을 받습니다.

（2）查验鉴别服务。POIZON平台为您售卖的商品或您在线提交的商品，并接入第三方服务商就商品进行查验鉴别。第三方查验鉴别服务商利用多年积累的查验鉴别商品（包括鞋类、服装、箱包、配饰、手表等物品）的行业经验及行业公信力为用户提供交易物品的查验服务。请注意，在不进行任何售卖或购买行为时，您也可以单独使用平台的鉴别服务。

(2) Commodity inspection services. POIZON Platforms helps you inspect and identify you sell or submit online in cooperation with the third party service providers. The third party inspection service providers serve the User with years of experience in commodity inspection (including shoes, clothing, cases & bags, accessories, watches, etc.) and trustworthy credibility in the industry. For the avoidance of doubt, you may also enjoy the inspection services on the Platform without selling or buying any commodity.

（2）검사 서비스를 제공합니다. POIZON 플랫폼은 서드 파티 업체와 함께 귀하가 판매한 상품이나 온라인에 제출한 상품을 검사합니다. 서드 파티 검사 업체는 다년간의 상품(신발, 의류, 가방, 액세서리, 시계 등) 검사 경험 및 업계 신용을 기반으로 사용자에게 검사 서비스를 제공합니다. 상품을 팔거나 사지 않아도 플랫폼의검사 서비스를 이용할 수 있습니다.

（1）POIZON平台采取的是商品竞价出价的电商平台交易模式，即由个人卖家对同一商品同一型号规格货品竞价出价，平台根据个人卖家出价由低至高排序后显示实时最低出价销售商品供个人买家选购。

(1) POIZON Platform adopts the e-commerce platform transaction mode of commodity bidding, i.e. individual sellers quote for commodities with the same brand, model and specifications and the Platform will display the commodity with the lowest real-time quotation for individual buyers after ranking the commodities based on their quotation from low to high.

（1）POIZON 플랫폼은 가격 경쟁의 이커머스 플랫폼 거래 모드를 채택합니다. 즉 브랜드, 모델, 사양이 동일한제품에 대해 개인 판매자가 가격을 제시하면 플랫폼은 낮은 가격에서 높은 가격순으로 상품을 배열한 후 개인구매자를 위해 실시간 최저 가격의 상품을 표시해 줍니다.

（2）商品的价格由卖家设定，平台不会为商品设定价格。商品的价格可能根据市场规律波动较大，因此商品价格可能高于零售价格。如果您是个人买家，您清楚知悉并了解，一旦您所购买的商品通过平台查验和确认并交付，所有售卖行为属于最终销售。请您按照自身决策方式酌情下单购买，POIZON平台不支持因价格波动导致的个人买家向个人卖家和/或向POIZON平台主张退货、退款，退还或额外支付因市场价格波动导致的差价。

(2) The price of commodity is set by the seller rather than the Platform. The price of commodity may fluctuate dramatically according to the market rules, so it may be higher than the retail price. If you are an individual buyer, you know and understand that all the sales are final sales once the commodity you purchase has been inspected and identified by the Platform, confirmed with you, and successfully delivered. Please place an order at your own discretion. POIZON Platform will not be responsible for any return or refund claim made by the individual buyer against the individual seller and/or POIZON Platform, nor refund or pay extra difference caused by market price fluctuation.

（2）상품 가격은 플랫폼이 아닌 판매자가 정합니다. 상품 가격은 시장 규칙에 따라 크게 변동할 수 있으므로 소매 가격보다 높을 수 있습니다. 개인 구매자의 경우, 구매한 상품이 플랫폼 검사를 통과하여 배송된 후에는 판매 행위가 종료되었음을 알고 계셔야 합니다. 따라서 신중하게 주문해 주시기 바랍니다. POIZON 플랫폼은 구매자가 판매자 또는 POIZON 플랫폼에 제기한 가격 변동으로 인한 반품, 환불 청구에대해 책임지지 않으며 시장 가격 변동으로 인한 차액을 반환 또는 추가 지불하지 않습니다.

4、受限于POIZON平台现有的服务能力与运营能力，目前我们暂未向欧盟地区（包括欧盟经济区与英国地区）的用户开放使用，如果您是来自上述地区的用户，我们将不能为您提供服务，请您予以理解。

4. POIZON Platform is temporarily not opened to users in European Union (including the European Economic Area and the UK) due to limited service and operation capabilities of POIZON Platform. If you are from the aforesaid areas, it is with regret that we cannot offer you corresponding services.

4.POIZON 플랫폼의 제한된 서비스 및 운영 능력으로 인해 당사는 유럽 연합 지역(유럽 연합 경제 지역과 영국포함)에 잠시 서비스를 개방하지 않습니다. 상술한 지역의 사용자일 경우, 서비스를 제공할 수 없는 점을 이해해주시기 바랍니다.

5、鉴于POIZON平台目前仅在部分地区的应用分发平台上线，在商品我们将要求您填写位于可服务地区的物理上的收货/回寄地址，如果您作为个人买家且无法提供真实、准确的并符合平台条件的地址，我们可能将无法为您成功寄送商品。

As POIZON Platform is only available on application distribution platforms in some areas now, when using the Platform, you may be requested to fill in the physical receiving/return address in areas within our range of service. If you are an individual buyer and can’t provide a true, accurate address that satisfies the requirements of the Platform, we may not be able to successfully send commodity for you.

5.POIZON 플랫폼은 현재 일부 지역의 앱 배포 플랫폼에서만 사용할 수 있으므로 귀하는 플랫폼을 사용할 때 서비스 범위 내에 있는 지역의 수령/반송 주소를 기입해야 합니다. 개인 구매자로서 진실하고 정확하며 플랫폼의요구를 충족하는 주소를 제공할 수 없을 경우 당사는 귀하에게 제품을 배송할 수 없게 됩니다.

6、除非本协议另有其他明示规定，POIZON平台有权随时强化现有功能或增加任何新功能，包括在POIZON平台上推出任何新的服务内容。

6. Unless otherwise clearly stipulated herein, POIZON Platform is entitled to optimizing existing functions or add any new functions, including launching any new services on POIZON Platform.

6.본 협의에 별도로 명시되어 있지 않은 한, POIZON 플랫폼은 수시로 기존 기능을 강화하거나 새로운 서비스를선보이는 등 새로운 기능을 추가할 권리가 있습니다.

1、您应确保在注册及使用平台服务时所填写的信息均真实、合法、有效。若您提供任何违法、无效、虚假的信息，或提供违法、侵权、不道德或POIZON平台认为不适合在平台上展示的资料，或者POIZON平台有理由怀疑您的资料属于恶意程序或恶意操作，POIZON平台有权冻结、关闭您的帐号、取消您的订单、拒绝您于现在和未来使用POIZON平台服务的全部或任何部分或采取其他合理措施；如给POIZON平台造成损失的，您应承担赔偿责任。

1. You shall ensure the authenticity, legality and effectiveness of all the information filled in for registration and use of the services on the Platform. POIZON Platform is entitled to freeze and/or close your account, cancel your orders, stop you from using any or all of the services on POIZON Platform now and in the future, or take all other rational measures if you provide any illegal, invalid or false information, provide any information that is illegal, infringing, unethical or deemed by the Platform improper to be displayed on POIZON Platform, or POIZON Platform is justified to suspect that your information is malicious program or malicious operation. And you shall be liable for the losses caused to POIZON Platform therefrom, if any.

1.귀하는 플랫폼 가입과 서비스 사용을 위해 작성된 정보의 진실성, 합법성, 유효성을 확보해야 합니다. 귀하가불법, 무효, 허위 정보를 제공하거나 불법, 권익 침해, 비윤리 또는 POIZON 플랫폼에 의해 게시가 적합하지 않다고 간주되는 자료, 또는 POIZON 플랫폼이 악성 프로그램 또는 악의적인 조작이라고 의심할 만한 충분한 근거가 있는 자료를 제출했을 경우, POIZON 플랫폼은 귀하의 계정을 동결하고 주문을 취소하며 귀하가 현재와 미래에 POIZON 플랫폼 서비스의 전부 또는 일부를 사용하지 못하게 하거나 기타 합리적인 조치를 취할 것입니다. POIZON 플랫폼에 손실을 입혔을 경우 귀하가 배상 책임을 져야 합니다.

2、如您作为个人卖家在平台售卖商品，您需在平台绑定您的PayPal账户，以便您接收交易款项。

2. If you sell commodities on the Platform as individual seller, you shall bind your PayPal account with the Platform to receive payment for transaction.

2.개인 판매자로서 플랫폼에서 상품을 판매할 경우 거래 대금을 받을 수 있도록 플랫폼에 PayPal 계좌를 바인딩해야 합니다.

3、您完成申请注册手续后，获得了POIZON平台账户的使用权，该使用权仅属于您本人，您不得对该账户进行任何的赠与、借用、租用、转让或售卖行为。同时，您不得通恶意注册、不当注册或不当使用POIZON平台的账户。若您有前述情形，POIZON平台有权直接采取一切必要措施，取消您在POIZON平台的一切权利、权益，包括但不限于删除发布内容、暂停、查封、冻结账户、取消订单、停止提供服务，删除您相关信息、收回您的POIZON平台账户、通过诉讼等方式追究您的责任。

3. You will be granted with the right to use POIZON Platform account after you complete the application and registration. You are the sole owner of the said right to use, and shall not grant, lend, lease, transfer or sell such right to others. You shall not maliciously or improperly register or use POIZON Platform account. If you commit any of the foregoing behaviors, POIZON Platform is entitled to take all necessary measures and cancel any and all your rights and interests on POIZON Platform, including but not limited to deleting the contents you release, suspending, attaching or freezing your account, canceling your orders, stopping provision of services, deleting your information, taking back your POIZON Platform account, and/or investigating your responsibilities by means of litigation.

3.가입을 완료하면 POIZON 플랫폼 계정을 사용할 수 있는 권한이 부여됩니다. 귀하는 해당 권한의 유일한 소유자이며 이런 권한을 타인에게 부여, 대여, 임대, 양도 또는 판매할 수 없습니다. 귀하는 악의적이거나 부적절하게POIZON 플랫폼 계정을 등록하거나 사용해서는 안 됩니다. 귀하가 이런 행위를 했을 경우, POIZON 플랫폼은필요한 조치를 취하여 귀하의 POIZON 플랫폼 상에서의 모든 권리와 권익을 취소할 것입니다. 이런 조치는 게시내용 삭제, 정지, 봉쇄, 계정 동결, 주문 취소, 서비스 제공 중지, 귀하 관련 정보 삭제, 플랫폼 계정 회수, 소송 등방식으로 귀하의 책임을 추궁하는 것을 포함하지만 여기에 국한되지 않습니다.

4、您的账户由您自行设置用户名及密码并保管，您务必保管好您的账号及密码。如果由于您未妥善保管自己的账号和密码而对您或第三方造成任何损失或损害，POIZON平台无法也不承担任何法律责任。您应通过司法、行政等救济途径向侵权行为人追偿，并自行向第三方承担法律责任，POIZON平台将在行政或司法机关的要求下提供必要的配合及协助。

4. You shall set and properly keep your account name and password. POIZON Platform cannot and is not obliged to bear any legal responsibility for any loss or damage to you or any third party caused by your failure to properly keep your account and password. You shall recover from any infringer through judicial, administrative or other remedies, and take legal responsibilities for the third party by yourself. POIZON Platform will give necessary cooperation and assistance as required by the relevant administrative or judicial authority.

4．계정 아이디와 비밀번호는 귀하 스스로 설정하고 보관해야 합니다. 따라서 계정과 비밀번호를 잘 보관하십시오. 귀하가 계정과 비밀번호를 잘 보관하지 않아 발생한 귀하 또는 서드 파티의 손실에 대해 POIZON 플랫폼은 법적 책임을 지지 않으며 질 수도 없습니다. 귀하는 사법, 행정 등 구제 경로를 통해 침해자로부터 보상을요구하고 서드 파티에 법적 책임을 져야 합니다. POIZON 플랫폼은 행정 또는 사법 기관의 요구에 따라 필요한협조와 지원을 제공할 것입니다.

5、您应对您账户下的所有行为及结果负责，包括但不限于发布信息、购买/出售商品或服务、在线签署各类协议等。

5. You shall be responsible for all the behaviors and consequences under your account, including but not limited to releasing information, buying/ selling commodities or services, signing agreements online, etc.

6. You are suggested to immediately notify POIZON Platform of any unauthorized use of your POIZON Platform account or any other account security problems. POIZON Platform will not be liable for any further loss during acceptance, save that POIZON Platform commits statutory fault.

7. You shall not develop or entrust any third party to develop/ use applications to hack POIZON Platform for batch data capture and download. POIZON Platform explicitly prohibits any data capture. If you are found to commit the foregoing behaviors, POIZON Platform is entitled to ban your account and confiscate all your funds therein, and hold you responsible for all the losses caused to POIZON Platform.

1、当您是个人卖家，您承诺通过POIZON平台交易的商品应当符合保障人身、财产安全的要求和环境保护要求，不得销售适用法律、行政法规禁止交易的商品。如有违反前述约定的，POIZON平台有权采取冻结、关闭您的帐号、取消您的订单、拒绝您于现在和未来使用POIZON平台服务的全部或任何部分或采取其他合理措施，并有权向有关主管部门反映。如给POIZON平台造成损失的，您应承担赔偿责任。

1. When you are an individual seller, you undertake that your commodities transacted on POIZON Platform satisfy all the requirements on personal and property security and environmental protection, and that you will not sell any commodity prohibited by applicable laws and administrative regulations. If you commit violation of the foregoing, POIZON Platform is entitled to freeze and/or close your account, cancel your orders, stop you from using any or all of the services on POIZON Platform now and in the future, or take all other rational measures, and report to the relevant competent authority. And you shall be liable for the losses caused to POIZON Platform therefrom, if any.

2、您应当清楚准确地填写属于所在服务地区的商品送达/回寄地址、联系人及联系方式等配送信息。用户知悉并确认，当个人买家购买的商品未通过查验或个人卖家所出售的商品发生未通过查验或交易取消等情形时，我们会将您的商品寄送/退回至您填写的地址，并由您填写的联系人接受身份查验后接收商品，因您变更联系人或相关配送信息而造成的损失由您自行承担。

2. You shall clearly and accurately fill in the delivery/ return address, contact, contact information and other delivery information within the service area. The User knows and confirms that, when the commodity purchased by the individual buyer or sold by the individual seller fails to pass the inspection, or the transaction is canceled, we will send/return your commodity to the address you fill in and the contact person you filled in will receive the commodity after his/her identity is verified. Any and all losses caused by your change in contact or the relevant delivery information shall be at your cost.

3、您作为个人卖家时，POIZON平台将通过Hyperwallet或其他第三方支付方式向您支付货款。您使用Hyperwallet或者其他第三方支付公司提供的支付服务时，需遵守支付方的相关服务规定。您作为个人买家时，您可通过您自行选择且平台支持的支付方式向个人卖家进行支付，您使用第三方的支付服务需要遵守第三方支付服务提供商的相关服务规定，如Hyperwallet的链接。

3. When you are an individual seller, POIZON Platform will pay you the commodity payment through Hyperwallet or other third party payment methods. You shall observe the relevant services regulations when using the payment services offered by Hyperwallet or other third party payment companies. When you are an individual buyer, you may make payment to the individual seller through the payment method you choose and supported by the Platform. You shall observe the relevant services regulations when using the payment services offered by third party payment service providers, such as the link of Hyperwallet .

3.귀하가 개인 판매자일 경우, POIZON 플랫폼은 Hyperwallet 또는 기타 서드 파티 결제 방법을 통해 귀하에게 대금을 지급합니다. Hyperwallet 또는 기타 서드 파티 결제 회사에서 제공하는 결제 서비스를 이용할 때에는 관련 서비스 규정을 준수해야 합니다. 개인 구매자일 경우에는 플랫폼에서 지원하는 결제 방식 중에서 스스로 선택하여 판매자에게 대금을 지급할 수 있습니다. Hyperwallet 링크 등 서드 파티 결제 서비스 업체가 제공하는 결제 서비스를 사용할 때에는 관련 서비스 규정을 준수해야 합니다.

4、鉴于个人卖家在POIZON平台出售的商品为个人闲置物品，多数情况下出售的同一商品同一型号规格仅为一件，因此个人卖家以及平台都无法支持换货，且非商品质量问题亦无法支持退货，但个人买家可在平台上再次以个人卖家的身份进行出售。关于具体的退货的规定请阅读《POIZON平台买家须知》[LZ1]。

4. Considering that the commodities sold by individual sellers on POIZON Platform are their idle items and that there is only one commodity with the same model and specifications in most cases, so individual sellers and the Platform don’t support the exchange of commodity and refund of commodities without quality problems. Nevertheless, individual buyer may resell the commodity on the Platform as an individual seller. Please refer to Instructions for Buyers of POIZON Platform for specific regulations on refund of commodity.

5. It is the aspiration of POIZON Platform that the User can keep covenants. Therefore, the sales contract is executed once your commodity is successfully ordered by the buyer via bidding and you are not entitled to cancel the order. If you cancel the order in violation of rules (e.g. you refuse to accept the order, fail to ship the commodity on time, recall the express after shipment, etc.), you will be subject to the rules for treatment of POIZON Platform. Please carefully read Instructions for Sellers of POIZON Platform, Instructions for Buyers of POIZON Platform, and other agreements and relevant rules for specific transaction rules.

（1） 作为购买交易的一部分，个人卖家应将商品邮寄到POIZON平台指定收货地址，POIZON平台将联合第三方查验服务商（例如：查验鉴别师）为用户提供商品查验服务。目前该等查验服务将通过线上查验商品图片的方式进行，您应理解第三方查验服务商有时可能无法完全确定商品的真实性，但第三方查验服务商与我们仍然会采取商业上合理的努力来进行确认它的真实性问题。如果第三方查验服务商确定该商品是正品的，则POIZON平台会将其寄送给个人买家。如果第三方查验服务商确认商品不是正品，或无法合理地确认该商品的真实性的，那么POIZON平台将通知个人买家和个人卖家该商品未能通过查验，并将货款退回给个人卖家。此外，POIZON平台有权以任何理由拒绝任何商品，包括但不限于商品为假冒伪劣产品、商品或包装有损坏等情况。

(1) As a part of the transaction, the individual seller shall mail the commodity to the receiving address designated by POIZON Platform. POIZON Platform will provide the User with the commodity inspection services in cooperation with the third party inspection service providers (e.g. inspection professionals). Currently, the inspection will be performed online by checking pictures of the commodity. You shall understand that the third party inspection service provider may sometimes not be able to completely determine the authenticity of the commodity. Nevertheless, the third party inspection service provider and we will still make commercially reasonable efforts to confirm its authenticity. If the third party inspection service provider determines that the commodity is genuine, POIZON Platform will send it to the individual buyer. If the third party inspection service provider determines that the commodity is not genuine or the authenticity of the commodity cannot be reasonably confirmed, POIZON Platform will inform the individual buyer and the individual seller that the commodity fails to pass the inspection, and refund the payment to the individual seller. In addition, POIZON Platform is entitled to refuse any commodity for any reason, including but not limited to counterfeit and shoddy commodity, damaged commodity or package, etc.

（1）거래의 일환으로 개인 판매자는 POIZON 플랫폼이 지정한 수령 주소로 상품을 보내야 하고 POIZON 플랫폼은 서드 파티 검사 서비스 업체(예: 검사 감별사)와 함께 사용자에게 상품 검사 서비스를 제공합니다. 현재 검사는 온라인에서 상품 사진을 검사하는 방식으로 이뤄지므로 서드 파티 검사 업체가 상품의 진위 여부를 완전히확인할 수 없는 경우가 있음을 이해해 주시기 바랍니다. 단 서드 파티 검사 업체와 당사는 상품의 진위를 판단하기 위해 상업적으로 합리적인 노력을 할 것입니다. 서드 파티 검사 업체가 상품이 정품이라고 판단하면 POIZON 플랫폼은 상품을 개인 구매자에게 배송합니다. 서드 파티 검사 업체가 상품이 정품이 아니거나 상품의 진위를합리적으로 확인할 수 없다고 판단한 경우, POIZON 플랫폼은 구매자와 판매자에게 상품이 검사를 통과하지 못했음을 알리고 대금을 판매자에게 환불합니다. 또한 POIZON 플랫폼은 어떠한 이유로든 상품을 거부할 권리가있습니다. 이런 이유는 제품이 위조품 및 불량품인 경우, 상품 또는 포장이 파손된 경우를 포함하지만 여기에 국한되지 않습니다.

（2）POIZON平台要求个人卖家在购买后必须在销售确认电子邮件中指定的期限内完成发货。但是，由于POIZON平台无法控制商品到达POIZON平台所花费的时间，因此我们无法保证任何商品都有特定的交货时间。我们也会在平台页面及时更新信息，以便您了解交易进展。

(2) POIZON Platform requires that the individual seller must consign the commodity within the time limit specified in the sales confirmation email after the individual buyer purchases the commodity. However, as the time when the commodity is delivered to POIZON Platform is out of POIZON Platform’s control, we cannot make commitment on specific delivery time for all commodities. We will update the information on the Platform from time to time, so that you can know the progress of transaction.

（2）POIZON 플랫폼은 개인 구매자가 상품을 구매한 후 개인 판매자가 판매 확인 이메일에 명시된 기한 내에상품을 발송할 것을 요구합니다. 그러나 POIZON 플랫폼은 상품이 POIZON 플랫폼에 도착하는 데 걸리는 시간을 제어할 수 없기 때문에 모든 상품에 대해 특정 배송 시간을 약속할 수 없습니다. 당사는 귀하가 거래 진행 상황을 확인할 수 있도록 플랫폼의 정보를 제때에 업데이트할 것입니다.

（3）如果该商品已经在个人卖家约定的期限之内从个人卖家处发货，则不允许个人买家取消订单。不论何种情况，如果用户未收到任何商品，请您立即将问题报告给POIZON平台。

(3) If the commodity has been shipped by the individual seller within the time limit agreed by the individual seller, the individual buyer shall not cancel the order. In any case, if the User does not receive the commodity, please notify POIZON Platform immediately.

（3）해당 상품이 이미 개인 판매자가 약속한 기한 내에 발송되었다면 구매자는 주문을 취소할 수 없습니다. 사용자가 상품을 받지 못했을 경우 즉시 POIZON 플랫폼에 통지하십시오.

（4）POIZON平台有权根据本协议约定的条款决定是否接受退货或其他退款要求，并可能对于个人卖家或个人买家原因造成的不按规定进行发货或擅自取消订单等行为造成的运费损失、包装损失、查验损失等收取与此对应的费用。

(4) POIZON Platform is entitled to decide whether to accept return or other requests for refund in accordance with the terms agreed herein, and may charge corresponding fees for freight loss, packaging loss, inspection loss, etc. caused by the individual sellers or individual buyers, such as failure to deliver the commodity as required or unauthorized cancellation of orders.

（4）POIZON 플랫폼은 본 협의 약관에 따라 반품 또는 기타 환불 요청에 대한 수락 여부를 결정할 수 있으며개인 판매자 또는 구매자가 규정에 따라 배송하지 않았거나 주문을 무단으로 취소하여 발생한 운송 손실, 포장손실, 검사 손실 등에 대해 비용을 청구할 수 있습니다.

7、个人买家签收商品时应仔细查验商品，如发现商品（含部件）存在破损、毁损或遗失，请第一时间提供清晰的照片、订单号向POIZON平台客服寻求帮助，并在收货后14日内联系平台，并将商品及鉴别证书、防伪扣连同原包装箱完好退回，防伪扣拆除视为个人买家认可商品。如个人买家未在14日内联系客服或因主张质量问题退回的商品不存在个人买家所述质量问题的或商品符合《POIZON平台买家须知》所述正常质量情况的，则POIZON平台无法受理个人买家退货申请。

7. Individual buyer shall carefully check and inspect the commodity when signing for receipt. In the case of any damage or loss of the commodity (including components), the individual buyer shall promptly provide clear photos and order number to the customer service personnel of POIZON Platform to seek help, contact the Platform within 14 days upon receipt of the commodity, and return the commodity, inspection certificate, anti-counterfeit buckle and the original packaging box to the Platform in sound condition. It is deemed that the individual buyer accept the commodity if the anti-counterfeit is removed. POIZON Platform cannot accept the individual buyer’s request for refund if the individual buyer does not contact the customer service personnel of POIZON Platform within 14 days, or the quality problem(s) claimed by the individual buyer is(are) not found, or the commodity satisfies the normal quality standards specified in the Instructions for Buyers of POIZON Platform.

7.개인 구매자는 상품을 수령할 때 상품을 꼼꼼히 검사해야 합니다. 상품(부품 포함)이 손상, 훼손 또는 분실되었을 경우 즉시 사진과 주문 번호를 POIZON 플랫폼 서비스 센터에 제공하여 도움을 청해야 하며 상품 수령 후 14일 내에 플랫폼에 연락하여 상품, 감별 증서, 위조 방지 버클을 원래의 포장에 넣어 반송해야 합니다. 위조 방지버클을 떼어내는 것은 구매자가 상품을 수락하는 것으로 간주됩니다. 구매자가 14일 내에 서비스 센터에 연락하지 않거나, 품질 문제로 반품된 상품에서 구매자가 주장하는 품질 문제가 발견되지 않거나, 상품이 <POIZON 플랫폼 구매자 주의 사항>에 명시된 정상 품질 기준에 부합되는 경우 POIZON 플랫폼은 구매자의 반품 요청을 수락할 수 없습니다.

8、因商品价值较高，您应使用POIZON平台指定的快递/物流公司向POIZON平台寄件，并加固商品外包装。如出现使用非指定快递、到付件、包装盒破损、质量检验不通过、运单号无法匹配订单号等情形的快递商品，平台有权进行拒收；如因此造成取消订单、退货及相应后果的，POIZON平台不承担责任。

8. Considering the high value of the commodity, you shall mail the commodity to POIZON Platform through the express/ logistics company designated by POIZON Platform, and reinforce the outer packing. The Platform is entitled to refuse any commodity mailed through the express company not designated by the Platform, mailed by means of freight at destination, with damaged packing box, failing to pass the quality inspection, or with way bill number that is inconsistent with the order number. POIZON Platform is not liable for the cancellation of order, refund and corresponding consequences arising therefrom.

8.상품의 높은 가격을 고려하여 귀하는 POIZON 플랫폼에서 지정한 택배/물류 회사를 통해 POIZON 플랫폼으로 상품을 발송하고 외부 포장을 보강해야 합니다. 플랫폼에 의해 지정되지 않은 택배 회사를 통해 발송되었거나, 착불로 발송되었거나, 포장 박스가 파손되었거나, 품질 검사를 통과하지 못했거나, 주문 번호와 매칭되지 않는 운송장 번호를 사용하여 발송된 상품에 대해 플랫폼은 수령을 거부할 권리가 있습니다. 이로 인해 주문이 취소되었을 경우, POIZON 플랫폼은 반품 및 그로 인해 발생하는 결과에 대해 책임지지 않습니다.

9、POIZON平台一直致力于打击假冒伪劣商品。为此，POIZON平台依据平台优势的第三方查验服务资源为用户提供商品的查验服务。如POIZON平台委托的第三方查验服务提供商的查验出现失误，POIZON平台将对查验服务的失误承担赔偿责任。因POIZON平台并非销售主体，因此该等责任的承担，并不应被视为POIZON平台存在售假行为所承担的赔偿责任。

9. POIZON Platform has always been committed to cracking down on counterfeit and shoddy commodities. Therefore, POIZON Platform provides the User with commodity inspection services resorting to its abundant third party inspection service resources. POIZON Platform will assume compensation liability for any mistake made by the third party inspection service provider in commodity inspection. However, as POIZON Platform is not the main body of sales, such compensation liability assumed by POIZON Platform shall not be regarded as the compensation liability borne by POIZON Platform for selling fake commodities.

9.POIZON 플랫폼은 항상 위조품 및 불량품을 단속하는 데 전념해 왔습니다. 따라서 POIZON 플랫폼은 풍부한서드 파티 검사 서비스 자원을 기반으로 하는 상품 검사 서비스를 사용자에게 제공합니다. POIZON 플랫폼은 서드 파티 검사 업체가 상품 검사에서 저지른 실수에 대해 배상 책임을 집니다. 다만 POIZON 플랫폼은 판매 주체가 아니므로 이러한 배상 책임을 POIZON 플랫폼이 가짜 상품 판매 행위에 대해 부담하는 책임으로 간주해서는안 됩니다.

10、POIZON平台抵制利用平台漏洞刷单、套现等获取不正当利益的行为，一经发现用户存在上述行为的，POIZON平台有权采取包括但不限于关闭交易订单、封禁用户账号、扣除保证金及账户馀额等措施；情节严重的，POIZON平台有权移交司法机关处理。

10. POIZON Platform resists any behavior aimed to obtain illegal benefits, such as click farming or cashing out by taking advantages of the Platform’s .vulnerabilities. Once the User is found to commit the aforesaid behaviors, POIZON Platform is entitled to take reasonable measures, including but not limited to closing transaction order, banning the User’s account, confiscating the guarantee and account balance. In the case of gross violation, POIZON Platform is entitled to submit to the judicial authority.

10.POIZON 플랫폼은 플랫폼 취약점을 이용한 허위 주문, 현금 인출 등 불법적인 이익을 얻기 위한 행위를 단속합니다. 사용자가 상기 행위를 한 것으로 판명될 경우 POIZON 플랫폼은 거래 주문 폐쇄, 사용자 계정 폐쇄, 보증금 및 계좌 잔액 공제를 포함하지만 여기에 국한되지 않는 조치를 취할 것입니다. 사태가 심각할 경우POIZON 플랫폼은 사법 당국에 보고할 권리가 있습니다.

1、当您是个人卖家时，POIZON平台有权要求您向POIZON平台预授权一定金额的保证金，用于保证您严格履约并维护POIZON App的合法权益，您同意授权POIZON平台依据相关协议、规则处置前述保证金。

When you are an individual seller, POIZON Platform is entitled to ask you to authorize a certain amount of guarantee to POIZON Platform in advance as the guarantee for your duly performance and protection of POIZON App’s legal interests. You agree to authorize POIZON Platform to dispose of such guarantee according to the relevant agreements and rules.

1.귀하가 개인 판매자일 경우, POIZON 플랫폼은 귀하에게 일정한 금액의 보증금을 요구할 권리가 있습니다. 이런 보증금의 지급은 귀하가 협의를 엄격하게 이행하고 POIZON 앱의 합법적 권익을 보호하는 것을 담보하기 위한 것입니다. 귀하는 POIZON 플랫폼이 관련 협의, 규칙에 따라 이러한 보증금을 처리하는 데 동의합니다.

2、当您是个人卖家时，针对正常交易成功的订单，POIZON平台将向您收取平台服务费，具体费用标准请查看《POIZON平台卖家须知》。

2. When you are an individual seller, POIZON Platform will charge you the platform service fees for orders successfully transacted in due course. Please refer to the Instructions for Seller of POIZON Platform for specific charging standards.

3、当个人买家收货后因个人原因发起退货导致交易不成功时，鉴于POIZON平台及其第三方查验服务提供方已向个人买家提供商品查验服务，因此个人买家需要承担商品查验服务费、包装服务费等（即「平台服务费」）及退货产生的快递物流等成本费用，POIZON平台有权直接从退款中直接扣除相应费用。具体费用标准请查看《POIZON平台买家须知》。

3. In the case of any unsuccessful transaction as a result of the individual buyer’s application for return of commodity for personal reasons after receiving the commodity, the individual buyer shall bear the commodity inspection service fees, packaging service fees, etc. (i.e. the “Platform Service Fees”), as well as the express fees, logistics fees and other costs caused by such return, considering that POIZON Platform and the third party inspection service provider has provided the individual buyer with the commodity inspection services. POIZON Platform is entitled to directly deduct the corresponding fees from the amount to be refunded. Please refer to the Instructions for Buyers of POIZON Platform for specific charging standards.

（1） 您需要承担商品的运输费，包括但不限于，商品寄送和/或回寄至POIZON平台指定收货地址的国际运输费、所有海关，关税，税金和任何其他相关费用,同时，您将全权负责遵守所有进口海关关于各类审批、清关等具体的要求。

(1) You need to bear the transport fee of the commodity, including but not limited to the international transport fee for mailing and/or returning the commodity to the address designated by POIZON Platform, all the custom duties and taxes, as well as other relevant fees. In the meantime, you shall be fully responsible for compliance with specific requirements of all import customs on various approvals and custom clearance.

（1）귀하는 상품 운송비를 부담해야 합니다. 이는 POIZON 플랫폼이 지정한 주소로 상품을 배송/반송하기 위한 국제 운송 수수료, 모든 세관비 및 관세와 세금, 기타 비용을 포함하지만 여기에 국한되지 않습니다. 동시에귀하는 모든 수입 세관의 각종 심사, 통관 등과 연관되는 특정 요구 사항을 준수할 책임이 있습니다.

（2）当您使用的第三方支付服务，第三方支付服务机构将可能向您收取一定支付手续费，这些费用将由您来承担。

(2) When you use the third party payment services, the third party payment service agency may charge you a certain payment fee, which will be at your cost.

（2）서드 파트 결제 서비스를 이용할 때, 서드 파티 서비스 기구는 귀하에게 일정한 수수료를 부과할 수 있으며이러한 비용은 귀하가 부담해야 합니다.

（3）当您访问和使用我们的产品及其服务时，第三方运营服务商可能向您收取网络费、流量费、电话费或其他费用，这些费用将由您来承担。

(3) When you access and use our products and services, the third party operators may charge you the network fees, traffic fees, telephone charges or other fees, which will be at your cost.

（3）귀하가 당사의 제품 및 서비스를 사용할 때 서드 파티 서비스 업체는 귀하에게 인터넷 요금, 데이터 요금, 전화 요금 또는 기타 요금을 청구할 수 있으면 이러한 비용은 귀하가 부담해야 합니다.

1、本软件可能需要您有适配兼容的终端设备及操作系统，否则可能影响本软件以及本服务的稳定兼容性。本软件的内容和功能有可能会根据您所使用的终端品牌、型号、操作系统的不同而有所不同或变化。您可以直接从POIZON网站（us.poizon.com/en）上获取POIZON客户端软件，也可以从得到POIZON平台授权的第三方获取，如果您从未经POIZON平台授权的第三方获取软件或与POIZON客户端软件名称相同的安装程序，POIZON平台无法保证该软件的安全性或适配性或该软件能够正常使用，您因此遭受的损失（例如文件受损、丢失），我们将不予负责。

1. To use the Software, you may need to have compatible terminal devices and operating systems, or the stability and compatibility of the Software and Service may be affected. The contents and functions of the Software may vary or change with the brand, model and operating system of the terminal device you use. You may obtain the POIZON client directly from POIZON’s website (us.POIZON.com/en), or from a third party authorized by POIZON Platform. If you obtain the software or the installation program with the same name as the POIZON client from a third party not authorized by POIZON Platform, POIZON Platform cannot guarantee the security, adaptability or normal use of the software, and will not be responsible for the losses (e.g. damage or loss of files) that you may suffer as a result.

POIZON 플랫폼의승인을 받지 않은 서드 파티에서 소프트웨어를 획득했거나 POIZON 소프트웨어와 이름이 동일한 설치 프로그램을 획득했을 경우, POIZON 플랫폼은 해당 소프트웨어의 안전성이나 적합성 또는 정상적인 사용을 보장할 수없으며 이로 인해 발생한 손실(예를 들어 파일 손상, 분실)에 대해 책임지지 않습니다.

3、您不得利用POIZON平台的账户或本协议项下的服务进行如下行为：

(1) 提交、发布虚假信息，或盗用他人头像或资料，冒充、利用他人名义的；

(1) Submitting or publishing false information, misappropriating others’ profile photo, or pretending to be others or using the name of others;

(1) 허위 정보 제출 또는 배포, 타인의 프로필 사진 또는 자료 도용, 타인 사칭 또는 명의를 이용하는 행위.

(2) 强制、诱导其他用户关注、点击链接页面或分享信息的；

(2) Forcing or inducing other users to like, click on linked pages, or share information;

(2) 다른 사용자에게 팔로우, 링크 클릭, 정보 공유를 강요하거나 유도하는 행위.

(3) 虚构事实、隐瞒真相以误导、欺骗他人的；

(3) Fabricating facts and concealing the truth to mislead or deceive others;

(3) 사실을 날조하거나 진실을 은폐하여 타인을 오도하거나 기만하는 행위.

(4) 利用技术手段批量建立虚假账号的；

(4) Opening false accounts in batches by technical means;

(5) 利用POIZON平台的账户或本协议项下的服务从事任何违法犯罪活动的；

(5) Using the POIZON Platform account or services hereunder for criminal and illegal activities;

(5) POIZON 플랫폼 계정이나 본 협의에 따른 서비스를 이용하여 불법 활동을 하는 경우.

(6) 制作、发布与以上行为相关的方法、工具，或对此类方法、工具进行运营或传播，无论这些行为是否为商业目的；

(6) Making and publishing methods and tools related to the aforesaid behaviors, or operating or disseminating such methods and tools, whether for commercial purposes or not;

(6) 상업 목적의 유무와 상관없이 상기의 행위와 관련된 방법 및 도구를 제조 또는 발표하거나 이런 방법 및 도구를 운영 또는 보급하는 행위.

(7) 其他违反法律法规规定、侵犯其他用户合法权益、干扰POIZON平台正常运营或POIZON平台未明示授权的行为。

(7) Other acts that violate the laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of POIZON Platform or that are not expressly authorized by POIZON Platform.

4、您须对利用POIZON平台账户或本协议项下的服务传送信息的真实性、合法性、无害性、准确性、有效性等全权负责，与您所传播的信息相关的任何法律责任由您自行承担，与POIZON平台无关；如因此给POIZON平台或第三方造成损害的，您应当依法予以赔偿。

4. You shall be fully responsible for the authenticity, legality, harmlessness, accuracy and effectiveness of the information transmitted by using POIZON Platform account or services hereunder. You shall bear any legal responsibility related to the information transmitted by you, which shall not be the responsibility of POIZON Platform. You shall compensate any damage caused to POIZON Platform or any third party therefrom according to law.

4.귀하는 POIZON 플랫폼 계정 또는 본 협의에 따른 서비스를 이용하여 전송되는 정보의 진실성, 합법성, 무해성, 정확성, 유효성에 대해 전적으로 책임을 져야 하고 귀하가 전파한 정보와 관련된 모든 법적 책임은 귀하에게있으며 POIZON 플랫폼과는 무관합니다. 이로 인해 POIZON 플랫폼 또는 서드 파티가 입은 손해에 대해서는 귀하가 법에 따라 부담해야 합니다.

5、POIZON平台提供的服务中可能包括广告，您同意在使用过程中显示POIZON平台和第三方供应商、合作伙伴提供的广告。除法律法规明确规定外，您应自行对依该广告信息进行的交易负责，对您因依该广告信息进行的交易或前述广告商提供的内容而遭受的损失或损害，POIZON平台不承担任何责任。

5. Services provided by POIZON Platform may include advertisements, and you agree that advertisements provided by POIZON Platform and third party suppliers and partners are displayed during your use of such services. Unless otherwise explicitly stipulated by laws and regulations, you should be responsible for the transactions conducted according to the aforesaid advertisement, and POIZON Platform will not be responsible for the losses or damages suffered by you as a result of such transactions or the contents provided by the aforesaid advertisers.

5.POIZON 플랫폼이 제공하는 서비스에는 광고가 포함될 수 있습니다. 귀하는 이러한 서비스를 사용하는 동안POIZON 플랫폼과 서드 파티 공급 업체, 협력 파트너가 제공하는 광고가 표시되는 데 동의합니다. 법률에 명시된 경우를 제외하고, 귀하는 이런 광고에 따라 이루어지는 거래에 대해 스스로 책임져야 합니다. 귀하가 광고를보고 진행한 거래 또는 앞서 언급한 광고 업체가 제공한 콘텐츠로 인한 손실 또는 손해에 대해 POIZON 플랫폼은 어떠한 책임도 지지 않습니다.

POIZON Platform hereby reminds you that, according to the relevant laws and regulations, the provider shall be assume any and all responsibilities arising from the texts, pictures, photos, videos, information or other data (hereinafter referred to as the “contents”) he/she publishes and/or uploads publicly or privately when using services hereunder.

1.관련 법률의 규정에 따라 본 협의에 따른 서비스를 통해 게시 또는 업로드된 텍스트, 사진, 도형, 동영상, 메시지 또는 기타 자료(이하 ‘콘텐츠’라 함)에 대한 책임은 그 방식이 공개, 비공개 여부와 상관없이 모두 콘텐츠 제공자가 부담해야 함을 알려드립니다.

2、POIZON平台仅为您提供内容存储空间，无法控制经由本协议项下的服务传送之内容，因此不保证内容的正确性、完整性或品质。您已预知使用本协议项下的服务时，可能会接触到令人不快、不适当或令人厌恶之内容。在任何情况下，POIZON平台均不为任何内容负责，但POIZON平台有权依法停止传输任何前述内容并采取相应行动，包括但不限于暂停您使用本协议项下的服务的全部或部分，保存有关记录，并向有关机关报告。

2. POIZON Platform only provides you with the space for storage of contents and is unable to control any contents transmitted when you use the services hereunder, so POIZON Platform makes no guarantee for the accuracy, integrity or quality of such contents. You have predicted that you may be exposed to unpleasant, inappropriate or disgusting contents when your use services hereunder. Under no circumstances shall POIZON Platform be responsible for any content, but POIZON Platform is entitled to stop transmitting any of the aforesaid contents and take corresponding measures, including but not limited to stop providing any or all services hereunder to you, saving the relevant records, and reporting to the relevant authority.

2.POIZON 플랫폼은 귀하에게 콘텐츠 저장 공간만 제공할 뿐, 본 서비스 이용 시 전송되는 콘텐츠를 제어할 수없으므로 콘텐츠의 정확성, 완전성, 품질을 보장할 수 없습니다. 귀하는 본 서비스 이용 시 불쾌하거나 부적절하거나 혐오스러운 내용을 접할 수 있음을 미리 알고 있습니다. 어떤 경우에도 POIZON 플랫폼은 이러한 내용에대해 책임지지 않지만 법에 따라 이러한 콘텐츠의 전송을 중지하고 이에 상응하는 조치를 취할 권한이 있습니다. 이런 조치는 본 협의에 따른 서비스의 전부 또는 일부에 대한 귀하의 사용을 중지하거나 관련 기록을 저장하고 유관 당국에 보고하는 것을 포함하지만 여기에 국한되지 않습니다.

2、POIZON平台在中华人民共和国香港地区运营业务收集或产生的数据均存储在中华人民共和国香港地区服务器内。

2. Data collected or generated by POIZON Platform in Hong Kong, People’s Republic of China are stored in servers in Hong Kong, People’s Republic of China.

3、POIZON平台将保存商品和服务信息、交易信息，POIZON平台可以根据实际情况依法自行决定您在本协议项下的服务中数据的最长储存期限（我们只会在达成本服务所述目的所需的期限内保留您的个人信息，除非法律有强制的存留要求。在您的个人信息超出保留期间后，或者在您注销账户后，我们会根据适用法律的要求删除您的个人信息，或使其匿名化处理），并在服务器上为其分配数据最大存储空间等。

3. POIZON Platform will store the information of commodity and services, as well as the transaction information, and POIZON Platform can decide the longest storage period of your data regarding the services hereunder according to law as the case may be (unless otherwise stipulated by law, we will only keep your personal information for the period required to achieve the purpose of the services stated herein). After your personal information exceeds the retention period or you cancel your account, we will delete your personal information or have your personal information anonymized according to the applicable laws, and allocate the maximum data storage space on the server.

3.POIZON 플랫폼은 상품 정보, 서비스 정보, 거래 정보를 저장하며 법에 따라 실제 상황에 근거하여 본 협의에따른 서비스를 위해 수집한 귀하의 데이터에 대해 최대 저장 기간(법률이 보관할 것을 요구한 경우를 제외하고, 당사는 본 서비스의 목적을 달성하기 위해 필요한 기간 동안만 귀하의 개인 정보를 보관합니다. 개인 정보 보관기간이 만료되었거나 귀하가 계정을 탈퇴하면 당사는 적용 법률에 따라 귀하의 개인 정보를 삭제하거나 익명화처리합니다)을 결정하고 이를 위해 서버에서 데이터 최대 저장 공간을 배치합니다.

1、本协议项下，POIZON平台将按「现状」和「可得到」的状态向您提供POIZON平台服务，将在现有技术的基础上尽最大努力提供相应对的安全措施以保障服务安全和正常运行。POIZON平台不对POIZON平台所涉及的技术及信息的是否有效、准确、可靠以及其质量、稳定、完整、及时向作出任何承诺和保证；亦对POIZON平台服务不做任何明示或暗示的保证，包括但不限于POIZON平台的服务是否适用、是否存在错误或疏漏、是否具有持续、准确、可靠等性能、是否适用于某一特定用途等。

1. For the purpose of the Agreement, POIZON Platform will provide you with POIZON Platform Services on “As Is” and “Available” basis, and will make the best effort to offer corresponding security measures based on existing technologies to ensure safe and normal delivery of the services. POIZON Platform does not make any commitment or guarantee to the validity, accuracy, reliability, quality, stability, integrity and timeliness of the technologies and information involved in POIZON Platform, and makes no express or implied guarantee for services on POIZON Platform, including but not limited to whether services on POIZON Platform are applicable, whether there are errors or omissions, whether such services are sustained, accurate and reliable, and whether such services are suitable for specific purpose, etc.

1.본 협의 목적을 위해 POIZON 플랫폼은 ‘있는 그대로’와 ‘사용 가능’의 기준으로 귀하에게 서비스를 제공할 것이며, 기존 기술에 기초하여 서비스 안전과 정상적인 운영을 위한 보안 조치를 제공하기 위해 최선을 다할 것입니다. POIZON 플랫폼은 POIZON 플랫폼과 관련되는 기술과 정보의 유효성, 정확성, 신뢰성, 품질, 안정성, 완전성, 적시성에 대해 약속이나 보장을 하지 않으며 POIZON 플랫폼의 서비스에 대해 어떠한 명시적 또는 암시적인보장도 하지 않습니다. 이런 보장의 내용은 POIZON 플랫폼의 서비스 적용 여부, 오류 또는 결함 유무, 지속성이나 정확성 및 신뢰성 유무, 특정 용도에 적용 여부 등을 포함하지만 여기에 국한되지 않습니다.

2、您理解并同意，您必须为自己注册账号下的一切行为负责，包括但不限于分享、传送、获取信息、在POIZON平台进行商品交易的行为以及由此产生的任何后果。您应在使用POIZON平台过程对自己注册账号下的一切行为自行加以判断，并承担因此引起的所有风险和责任，包括但不限于因正确性、完整性或实用性的依赖而产生的风险。POIZON平台无法且不会对因您行为而导致的任何损失或损害承担责任。

2. You understand and agree that you must be liable for all behaviors and acts done under your account, including but not limited to sharing, transmitting and/or acquiring information, as well as commodity transaction on POIZON Platform and any consequence arising therefrom. When using POIZON Platform, you shall judge your behaviors or acts under your registered account at your own discretion and assume any and all risks and responsibilities arising therefrom, including but not limited the risks caused due to independence on the accuracy, integrity or practicability of the information or services. POIZON Platform cannot and will not assume any responsibility for any and all losses or damages caused as a result of your behaviors.

2.귀하는 계정 등록에 따른 모든 행위에 책임져야 합니다. 이런 행위는 정보 공유, 전송, 획득 및 POIZON 플랫폼에서 상품 거래를 진행하는 행위와 이로 인해 발생하는 모든 결과를 포함하지만 여기에 국한되지 않습니다. 귀하는 POIZON 플랫폼을 사용하는 과정에서 계정 등록에 따른 모든 행위에 대해 스스로 판단하고 이로 인해 발생한 리스크와 책임을 감당해야 합니다. 이런 리스크는 정확성, 완전성, 실용성에 대한 의존으로 인한 리스크를 포함하지만 여기에 국한되지 않습니다. POIZON 플랫폼은 귀하의 행위로 인해 발생한 손실과 손해에 대해 책임지지 않습니다.

如果POIZON平台发现或收到他人举报或投诉您违反本协议约定或以其他不当的方式使用本协议项下的服务或存在任何疑似或足以认定为恶意行为的，POIZON平台有权不经通知随时对相关内容进行删除、屏蔽，并视行为情节对违规帐号处以包括但不限于警告、限制或禁止使用部分或全部功能、帐号封禁、注销等措施。

If POIZON Platform discovers or receives report or complaint from others that you constitute breach of the Agreement or use the services hereunder by other improper means, or that you are suspected of or firmly believed to have malicious acts, POIZON Platform is entitled to delete and block the relevant contents without any notification, and take other necessary measures as the case may be, including but not limited to warning, restriction or prohibition of part or all of the functions, banning and/or canceling the account, etc.

POIZON 플랫폼은 귀하가 본 협의를 위반했거나, 기타 부당한 방식으로 본 협의에 따른 서비스를 사용했거나, 악의성이 있다고 의심 또는 판단할 수 있는 행위를 한 사실을 발견했을 경우 또는 다른 사람의 신고를 통해 이런사실을 알게 되었을 경우 별도의 통지 없이 관련 내용을 삭제, 차단할 권리가 있고 경우에 따라 규정을 위반한 계정에 조치를 취할 수 있습니다. 이런 조치는 경고, 일부 또는 전부 기능의 사용에 대한 제한 또는 금지, 계정 봉쇄, 계정 말소 등을 포함하지만 여기에 국한되지 않습니다.

3、POIZON平台有权依据合理判断对违反有关法律法规或本协议规定的行为采取适当的法律行动，并依据法律法规保存有关信息向有关部门报告等，您应独自承担由此而产生的一切法律责任。

POIZON Platform is entitled to take appropriate legal actions against violations of the relevant laws and regulations or the provisions herein at its reasonable discretion, keep the relevant information according to laws and regulations, and report to the relevant departments, etc. You shall assume all legal responsibilities arising therefrom.

3.POIZON 플랫폼은 합리적인 재량에 따라 관련 법률 및 법규 또는 본 협의를 위반한 행위에 대해 적절한 법적조치를 취하고 법에 따라 관련 정보를 보관하며 유관 당국에 보고할 수 있는 권리를 가집니다. 이로 인해 발생하는 모든 법적 책임은 귀하 스스로 부담해야 합니다.

4、您理解并同意，因业务发展需要，POIZON平台保留单方面对本协议项下的服务的全部或部分服务内容变更、暂停、终止或撤销的权利，且POIZON平台将在平台进行公告。

4. You understand and agree that POIZON Platform is entitled to unilaterally change, suspend, terminate or cancel all or part of the services hereunder for business development,, and POIZON Platform will make corresponding announcement on the Platform.

4.업무 발전의 수요에 따라 POIZON 플랫폼은 일방적으로 본 협의에 따른 서비스의 전부 또는 일부 내용을 변경, 중단, 종료 또는 취소할 수 있는 권리를 가집니다. POIZON 플랫폼은 이런 사실을 플랫폼에 공지할 것입니다.

5、POIZON平台仅作为闲置物品信息发布及交易电商平台，就用户之间的物品交易活动提供平台以展示物品/服务信息、撮合交易、就物品/服务的交易提供查验服务，除POIZON平台另有约定外，POIZON平台并不作为交易双方之任何一方的身份参与交易行为，且POIZON平台不对用户交易履行能力负责。本协议的签署并不意味着POIZON平台为POIZON平台上交易双方的行为合法性、有效性提供任何明示或暗示的担保或承诺。

5. POIZON Platform is only an e-commerce platform for release of information about and transaction of idle items, which displays commodity/ service information, facilitates the transaction, and offers inspection services for commodity/ service transaction between users. Unless otherwise agreed by POIZON Platform, POIZON Platform does not participate in the transaction in the capacity of either party and will not be liable for the contractual capabilities of the User. The execution of the Agreement does not mean POIZON Platform makes any express or implied guarantee or commitment for the legality and effectiveness of the actions of parties involved in the transaction on POIZON Platform.

5.POIZON 플랫폼은 개인 유휴 물품 정보 게시 및 거래를 위한 이커머스 플랫폼으로서 사용자 간의 물품 거래를위해 플랫폼을 제공하여 물품/서비스 정보를 게시하고 거래를 성사시키며 물품/서비스 거래를 위해 검사 서비스를 제공합니다. 별도로 약정된 경우를 제외하고, POIZON 플랫폼은 거래 쌍방 중 일방의 신분으로 거래에 참여하지 않으며 사용자의 거래 능력에 대해 책임지지 않습니다. 본 협의를 체결하는 것은 POIZON 플랫폼이 거래쌍방의 행위의 적법성, 유효성을 위해 명시적 또는 암시적인 보증 또는 약속을 하는 것을 의미하지 않습니다.

1、除非另有约定，您通过POIZON平台发布的所有内容的所有权、知识产权及其他法律权利，归您或您的许可方所有。您同意或者确保实际权利人同意：

1. Unless otherwise agreed, you or your licensor shall enjoy the ownership, intellectual property rights and other legal rights of all the contents you publish through POIZON Platform. You agree or ensure that the actual right holder agrees:

1.별도로 약정된 경우를 제외하고, 귀하가 POIZON 플랫폼을 통해 게시한 모든 콘텐츠의 소유권, 지식재산권 및기타 법적 권리는 모두 귀하 또는 귀하의 라이센서가 소유합니다. 귀하 또는 실제 권리자는 다음과 같은 사항에동의합니다.

（1）您同意将在本协议项下的服务中或通过本协议项下的服务所传送、发布的任何内容（包括但不限于文字、语音、图片、视频、图文），授予POIZON平台可在全球范围内、免费的、非独家的、可转授权的使用，使用范围包括但不限于在当前或其他网站、应用程序、产品或终端设备等，并授权POIZON平台对相应内容可进行修改、复制、改编、翻译、汇编或制作衍生产品。

(1) that you agree to grant POIZON Platform the worldwide, free, non-exclusive and delegable right to use any content that you have, transmit or publish under or through the services hereunder (including but not limited to texts, voice, pictures, videos and images) on but not limited to existing or other websites, apps, products or terminal devices, and that you agree to authorize POIZON Platform to modify, copy, recompose, compile, translate such contents or make any derivative products based thereon.

（1）귀하는 POIZON 플랫폼에 본 협의에 따른 서비스 이용과 관련된 모든 내용(텍스트, 음성, 이미지, 동영상, 텍스트 및 이미지를 포함하지만 여기에 국한되지 않음)을 전 세계 범위 내에서 무료, 비독점으로 사용하고 양도할 수 있는 권한을 부여합니다. 사용 범위는 기존 또는 기타 사이트, 앱, 제품 또는 단말기 등을 포함하지만 여기에 국한되지 않습니다. 또한 POIZON 플랫폼에 이런 내용을 수정, 복사, 편집, 번역, 편성하거나 파생 제품을 제작할 수 있는 권한을 부여합니다.

（2）您同意授权POIZON平台以公司名义或委托第三方对侵犯用户发布的享有知识产权的内容进行维权的权利。

(2) that you agree to authorize POIZON Platform to, in the name of a company, or entrust a third party to safeguard the rights against the contents with intellectual property rights published by infringing user.

（2）귀하는 POIZON 플랫폼이 회사 명의로 또는 서드 파티에 위탁하여 사용자가 게시한 지식재산권이 포함된콘텐츠에 대한 권리를 보호하는 데 동의합니다.

2、除另有特别声明外，POIZON平台提供本协议项下的服务时所依托软件的著作权、专利权及其他知识产权均归POIZON平台所有。

2. Unless otherwise specially stated, POIZON Platform shall be the owner of the copyright, patent rights and other intellectual property rights of the software based on which POIZON Platform provides services hereunder.

2.별도로 규정되어 있지 않는 한, POIZON 플랫폼이 본 협의에 따른 서비스를 제공할 때 사용하는 소프트웨어의저작권, 특허권 및 기타 지식재산권은 모두 POIZON 플랫폼의 소유입니다.

3、POIZON平台在本协议项下的服务中所涉及的图形、文字或其组成，以及其他POIZON平台标志及产品、服务名称（以下统称「POIZON平台标识」）等，其著作权或商标权归POIZON平台所有。未经POIZON平台事先书面同意，您不得将POIZON平台标识以任何方式展示或使用或作其他处理，也不得向他人表明您有权展示、使用、或其他有权处理POIZON平台标识的行为。

3. POIZON Platform shall be the owner of the copyright or trademark rights of graphics, texts or their components, as well as other marks, products and services of POIZON Platform (hereinafter referred to collectively as “POIZON Platform Marks”) when POIZON Platform provides services hereunder. Without the prior written consent of the POIZON Platform, you shall not display, use or otherwise treat POIZON Platform marks by any means, nor shall you show others that you have the right to display, use or otherwise treat POIZON Platform marks.

3.POIZON 플랫폼이 본 협의에 따른 서비스를 제공할 때 생성된 도형, 텍스트 또는 그 구성 요소, 기타 POIZON 플랫폼의 마크와 제품, 서비스 명칭(이하 ‘POIZON 플랫폼 마크’라 함） 등의 저작권 또는 상표권은 모두POIZON 플랫폼에 귀속됩니다. POIZON 플랫폼의 사전 서명 동의 없이 귀하는 POIZON 플랫폼 마크를 배포, 사용, 처리해서는 안 되며 POIZON 플랫폼 마크를 배포, 사용, 처리할 권리가 있다고 타인에게 밝혀서도 안 됩니다.

4、上述及其他任何POIZON平台或相关广告商依法拥有的知识产权均受到法律保护，未经POIZON平台或相关广告商书面许可，您不得以任何形式进行使用或创造相关衍生作品。

4. The aforesaid or any other property rights owned by POIZON Platform or the relevant advertisers are protected by law, and you shall not use such rights or create the relevant derivative products based thereon by any means without the written consent of POIZON Platform or the relevant advertisers.

4.POIZON 플랫폼 또는 관련 광고 업체가 법에 따라 소유하는 상기 또는 기타 지식재산권은 모두 법적 보호를받으며 귀하는 POIZON 플랫폼 또는 관련 광고 업체의 동의 없이 이러한 권리를 사용하거나 관련 파생 작품을제작해서는 안 됩니다.

1、如果POIZON平台发现或收到他人举报或投诉用户违反本协议约定的，POIZON平台有权不经通知随时对相关内容，包括但不限于用户资料、日志、交易记录进行审查、删除，并视情节轻重对违规账号处以包括但不限于警告、账号封禁、设备封禁、功能封禁、删除或屏蔽发布的信息、停止提供服务等处罚。

1. If POIZON Platform discovers or receives report or complaint from others that the User constitutes breach of the Agreement, POIZON Platform is entitled to review and delete the relevant contents, including but not limited to the User’s data, logs and transaction records, without any notification, and take other necessary measures as the case may be, including but not limited to warning, banning the account, device and/or functions, deleting or blocking the information published, stopping provision of services, etc.

1.POIZON 플랫폼은 사용자가 본 협의를 위반한 사실을 발견했거나 다른 사람의 신고를 통해 이런 사실을 알게되었을 경우, 별도의 통지 없이 관련 내용을 수시로 검토, 삭제할 권리가 있습니다. 이런 내용은 사용자 자료, 로그, 거래 기록을 포함하지만 여기에 국한되지 않습니다. 또한 상태의 심각성에 따라 규칙을 위반한 계정을 처벌할 수 있습니다. 이런 처벌은 경고, 계정 봉쇄, 기기 봉쇄, 기능 봉쇄, 발표한 정보 삭제 또는 차단, 서비스 중단 등을 포함하지만 여기에 국한되지 않습니다.

2、因违反用户协议或平台规则被封禁的用户不会自动解封。可向POIZON平台提交申诉，POIZON平台将对申诉进行审查，并自行合理判断决定是否变更处罚措施。

2. The User banned for violation of the User Agreement or rules of the Platform shall not be de-banned automatically. The banned user may submit the appeal to POIZON Platform who will review the appeal and decide whether to adjust the punishment or not at its reasonable discretion.

2.사용자 협의 또는 플랫폼 규칙을 위반하여 봉쇄된 계정은 자동으로 해제되지 않습니다. 이 경우에는 POIZON 플랫폼에 해제 신청을 제출하면 플랫폼이 이를 검토하여 처벌 조치 변경 여부를 결정할 것입니다.

3、您理解并同意，POIZON平台有权依合理判断对违反有关法律法规或本协议规定的行为进行处罚，对违法违规的任何用户采取适当的法律行动，并依据法律法规保存有关信息向有关部门报告等，您应承担由此而产生的一切法律责任。

3. You understand and agree that POIZON Platform is entitled to punish violations of the relevant laws and regulations or the provisions herein at its reasonable discretion, take appropriate legal actions against users constitute such violations, keep the relevant information according to laws and regulations, and report to the relevant departments, etc. You shall assume all legal responsibilities arising therefrom.

3.POIZON 플랫폼은 합리적인 재량에 따라 법률 및 법규 또는 본 협의를 위반한 행위에 대해 처벌하고 법률 및법규를 위반한 사용자에게 법적 조치를 취하며 법률 및 법규에 따라 관련 정보를 저장하고 유관 당국에 보고할권리가 있습니다. 이에 따른 모든 법적 책임은 귀하가 감당해야 합니다.

4、您理解并同意，因您违反本协议约定，导致或产生的任何第三方主张的任何索赔、要求或损失，包括合理的律师费、诉讼费/仲裁费，您应当赔偿POIZON平台及其合作方，并使之免受损害。

4. You understand and agree that you shall indemnify and hold POIZON Platform and its partners harmless from any and all claims, demands or losses claimed by any third party as a result of your violation of clauses hereof, including but not limited to the reasonable legal fees, litigation/ arbitration fees.

4.귀하의 약정 위반으로 인해 서드 파티가 주장한 배상금, 요구와 손실(변호사 수임료, 소송 비용/중재 비용 포함)에 대해서는 귀하가 POIZON 플랫폼 및 협력 업체에 배상금을 지급하여 손해를 입지 않도록 해야 합니다.

十一、不可抗力及其他免责事由

1、您理解并确认，在使用本协议项下的服务的过程中，可能会遇到不可抗力等风险因素，使本协议项下的服务发生中断。不可抗力是指不能预见、不能克服并不能避免且对一方或双方造成重大影响的客观事件，包括但不限于自然灾害如洪水、地震、瘟疫流行和风暴等以及社会事件如战争、动乱、政府行为等。出现上述情况时，POIZON平台将努力在第一时间与相关单位配合，及时进行修复，但是由此给您或第三方造成的损失，POIZON平台及合作公司在法律允许的范围内免责。

1. You understand and confirm that there may be force majeure or other risk factors that my interrupt the services hereunder during the validity period of the Agreement. For the purpose of the Agreement, force majeure refers to unforeseeable, insurmountable and unavoidable objective events that have a significant impact on any or both of the Parties, including but not limited to natural disasters such as flood, earthquake, plague, epidemics and storms, and social events like wars, disturbances and government actions. In the case of the aforesaid circumstances, POIZON Platform will strive to cooperate with the relevant organizations without delay to make rectification, provided however that POIZON Platform and its partners shall be exempted from liabilities for any and all losses caused to you or third parties therefrom to the extent permitted by law.

1.본 협의에 따른 서비스를 이용하는 과정에서 불가항력 등의 위험한 요인으로 인해 서비스가 중단될 수 있다는점을 이해해 주시기 바랍니다. 불가항력이란 예측할 수 없고 극복할 수 없으며 피할 수 없고 일방이나 쌍방에 큰영향을 줄 수 있는 사건을 가리킵니다. 이런 사건은 홍수, 지진, 역병과 폭풍 등과 같은 자연재해와 전쟁, 동란, 정부 행위 등과 같은 사회 사건을 포함하지만 여기에 국한되지 않습니다. 이런 상황이 발생했을 경우 POIZON 플랫폼은 관련 부서와 협력하여 제때에 복구할 수 있도록 노력할 것입니다. 그러나 귀하 또는 서드 파티에 발생한 손실에 대해 POIZON 플랫폼 및 협력 업체는 법률이 허용하는 범위 내에서 책임을 면제받습니다.
